NOTICE is hereby given that on December 9, 2019, co-applicants Handley Dairy, c/o David Handley 1134 S Hwy 304, Veguita, NM, 87062, and City of Belen c/o Leona Vigil, 100 S. Main St., Belen, NM, 87002 and on December 11, 2019 co-applicants Handley Dairy and Village of Los Lunas c/o Gregory D. Martin, P.O. Box 1209, Los Lunas, NM 87031 filed with the STATE ENGINEER Application No. (SP-2847-M into RG-18377 et al)-T, and Application No. (SP-2847-G into RG-18377 et al)-T for Permits to Temporarily Change Point of Diversion and Change Place and Purpose of Use of Surface Water to Groundwater within the Rio Grande Underground Water Basin of the State of New Mexico. Socorro and Valencia are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain and Valencia County News-Bulletin. Handley Dairy has a lease agreement with the City of Belen and Village of Los Lunas to release up to 150 acre-feet each, for a total of 300 acre-feet of San Juan/Chama project (SJ/CP) water under surface permit SP-2847-M and SP-2847-G respectively, used to offset historical over-diversions of water from the Rio Grande from the pumping of wells RG-18377 and RG-18377-S for dairy and related purposes on 17.3117 acres of land described as Tract B, also called "the dairy tract" of the exempt replat of Land of David and Audrey Handley Dairy comprising parts of Tracts 49, 50 and 51 on MRGCD Map 123 and an unnumbered 10 acre tract east of MRGCD, Socorro County, NM on land owned by Handley Dairy. Said 150 afa of SJ/CP water is released under surface permit SP-2847-M (Contract No. 0-07-40-R1070) dated February 8, 1990 between the City of Belen and the United States of America Contract. Additional 150 afa of SJ/CP water is released under surface permit SP-2847-G (Contract No. 05-WC-40-580) dated July 18, 2006 between the Village of Los Lunas and the United States of America. The wells are located approximately 4 miles south of the intersection of NM 346 and NM 304 in the town of Veguita, NM. The point of diversion for surface permit SP-2847-M and SP-2847-G is located on the Rio Chama (Heron Lake) at a point where X=347,493 meters and Y=4,059,153 meters, UTM 13N, NAD83, Tierra Amarilla Grant, on land owned by the U.S. Bureau of Reclamation, Rio Arriba County. The point of diversion at the Handley Dairy are wells RG-18377 located at a point where X=337,503 meters and Y=3,817,451 meters, UTM 13N, NAD83, and RG-18377-S located at a point where X=337,810 meters and Y=3,817,184 meters, UTM 13N, NAD83 on land owned by Handley Dairy in Socorro County. Under SP-2847-M into RG-18377 et al, Handley Dairy has contracted with the City of Belen to lease 50 acre-feet in 2019 and 100 acre-feet in 2020 of SJ/CP water. Under SP-2847-G into RG-18377 et al Handley Dairy has contracted with the Village of Los Lunas to lease 50 acre-feet in 2019 and 100 acre-feet in 2020 of SJ/CP water. To view the application and supporting documentation contact the Office of the State Engineer District I Office to arrange a date and time for an appointment at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District I Office, 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before February 28, 2020. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
