NOTICE is hereby given that on July 23, 2018 co-applicants, Sannes Family Trust, contacts Mark and Debra Sannes, Trustees, 4807 Reese Road, Torrance, CA 90505, William and Katie Harris, 6 Roper Lane, Belen, NM 87002, and Blatt Properties, LLC, a NM limited liability company, contacts Craig and Karen Blatt, Members, 1598 Coronado Road, Corrales NM 87048, filed Application No. SD-09712 into RG-97542 with the STATE ENGINEER for Permit to Change Point of Diversion, Place, and Purpose of Use from Surface to Groundwater in the Rio Grande Underground Water Basin of the State of New Mexico. The applicants propose to discontinue the farm delivery requirement of 10.71 acre-feet of surface water per annum (AFA), inclusive of a consumptive irrigation requirement of 7.497 AFA from the Harlan Lateral, with a point of diversion at the Isleta Diversion Works (SP-1690-3) of the MRGCD, at a point where X=346,037 meters, Y=3,863,880 meters, UTM Zone 13N, NAD83, on land owned by the Pueblo of Isleta, for the irrigation of 3.57 acres of land owned by the Sannes Family Trust and William and Katie Harris, described as Tract 22A1 (1.64 acres) and Tract 22A4 (1.93 acres), on MRGCD Map 81, within Section 8, Township 6 North, Range 2 East, NMPM, Valencia County, New Mexico. The above-described, move-from tracts are located east of Interstate 25, approximately 0.1 mile south of the intersection of NM Highway 314 and Phillips Road in Los Lunas, Valencia County, New Mexico. The applicants further propose to transfer the above described consumptive use amount to well RG-97542, also declared for domestic and livestock under RG-4158 and permitted for domestic use under RG-97175, with a point of diversion at a point where X=360,032 meters, Y=3,907,988 meters, UTM Zone 13N, NAD83, for domestic, KOA campground, mobile home park, and related purposes on 9.07 acres of land, described as Tract 32N (8.70 acres) of MRGCD Maps 10 and 11, within Section 32, Township 13 North, Range 4 East and Section 5, Township 12 North, Range 4 East, NMPM, and Tract 1A5 (0.37 acre) of MRGCD Map 11, within Section 5, Township 12 North, Range 4 East, NMPM, Sandoval County, New Mexico. The above described move-to well and land are owned by Meadow Village Partners, LLC, a Colorado limited liability company, Craig Terrace Partners, LLC, a Colorado limited liability company and Intermountain Mule Deer, LLC, a Colorado limited liability company. The above-described, move-to tracts are located west of Interstate 25, approximately 0.65 mile southwest of the intersection of Interstate 25 and Highway 550 in Bernalillo, Sandoval County, New Mexico. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, within ten (10) days after the date of the last publication of this Notice. Facsimiles (faxes) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
