NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me Special Master of this matter with the power to sell, has ordered me to sell the real property situated in Valencia County, State of New Mexico more particularly described as follows: Tract Three (3) of the Summary Replat and Land Division Plat of Lands of Jayson Epstein, as such tracts are shown and designated on said replat, filed in the Office of the County Clerk of Valencia County, New Mexico on February 15, 1995 in Plat Cabinet I Page 569. together with all improvements thereon. ("Property"). The Default Judgment appointing me Special Master and directing me to sell the Property was rendered in the above-entitled and numbered cause on September 18, 2019. The sale is to begin on November 8, 2019 at 9:30 a.m. on the steps of the Valencia County Courthouse, 1835 Highway 314 SW, Los Lunas, New Mexico, 87031 at which time I will sell to the highest bidder for cash in the lawful currency of the United States of America, the Property, to pay expenses of sale, and to satisfy the Default Judgment entered in the above-entitled action in favor of Joanne M. Kennedy, Co-Trustee and James L. Kennedy, Co-Trustee of the Living Trust of James R. Kennedy and Joanne M. Kennedy, in the amount of $225,635.60, plus interest thereon at the rate of 10% per annum at a per diem rate of $61.87 from December 31, 2018 through June 1, 2019 in the amount of $31,986.79, plus interest which shall accrue thereafter at the at rate of 10% per annum from June 1, 2019 through date of the foreclosure sale at the per diem rate of $70.33, plus tax disbursement of $20,774.97, costs in the amount of $1,241.75 and attorneys fees through September 17, 2019, in the amount of $9,759.99, including New Mexico Gross Receipt Tax thereon, plus attorneys fees incurred from September 18, 2019 through entry of order of sale, plus costs of the sale. Plaintiffs are allowed to bid the amount of its Judgment, or any portion thereof, at said sale as the equivalent of cash. The Property may be encumbered by other liens which were not foreclosed by this action, or may be subject to payment of taxes or other assessments; and, any purchaser of the Property shall take the Property subject to such liens, taxes, assessments or other encumbrances. /s/ Bryan L.
