NOTICE is hereby given that on May 6, 2022, Mario S. Gomez, 108 Maestas Rd, Belen, NM 87002, and the Village of Los Ranchos De Albuquerque, 6718 Rio Grande Blvd. NW, Los Ranchos, NM 87107, filed with the STATE ENGINEER Application numbered SD-08614 into RG-A0238 for Permit to Change Point of Diversion and Place and Purpose of Use from Surface Water to Groundwater within the Rio Grande Underground Basin of the State of New Mexico.

Valencia and Bernalillo Counties are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin and the Albuquerque Journal.

The co-applicants propose to discontinue the diversion and use of a farm delivery requirement (FDR) of 13.17 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (CIR) of 9.219 acre-feet per annum from the Old Jarales Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam of the MRGCD, on land owned by the Pueblo of Isleta, at a point where X = 346,037 and Y = 3,863,880 meters intersect, UTM Zone 13N, NAD83, for the irrigation of 4.39 acres of land, described as Tract 8A2A2 on MRGCD Map103. The move-from property falls within Section 29, Township 05 North, Range 02 East, NMPM. This move-from land is owned by Mario S. Gomez, and is generally located approximately 0.25 miles northwest of the intersection of Maestas Road and NM Highway 109 near Belen,Valencia County, New Mexico.

The co-applicants further propose to begin the diversion of 9.219 acre-feet per annum CIR from well RG-A0238, owned by the Village of Los Ranchos, located at a point where X = 348,637 meters and Y = 3,890,619 meters intersect, UTM Zone 13N, NAD 1983, for drip and sprinkler irrigation for sustainable agriculture use on 8.5 acres of land owned by the Village of Los Ranchos described as being within the west part of Tract 6A4A1, Plat of Los Ranchos Agri-Nature Center at Anderson Fields, MRGCD Map 30, located in Projected Section 30, Township 11 North, Range 03 East NMPM. The move-to place of use is generally located approximately 0.5 miles northeast of the intersection of Rio Grande Blvd NW and Montaño Road NW, Los Ranchos, Bernalillo County, New Mexico.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before Friday, August 5, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
