AN ORDINANCE

The City of Belen, New Mexico (the “City”) hereby gives notice of a regular meeting of the City Council (the “Council”) of the City on April 17, 2023, at the hour of 6:00 p.m. at Belen City Hall, 100 South Main St., Belen, New Mexico 87002. At such meeting, or as soon thereafter as the matter may be heard, the Council, constituting the governing body of the city, will hold a public hearing concerning, and will consider for adoption an ordinance (the “Ordinance”) relating to the City’s proposed ordinance approving an Economic Development Project as follows;

AN ORDINANCE APPROVING AN ECONOMIC DEVELOPMENT PROJECT FOR ARCOSA WIND TOWERS, INC., A DELAWARE CORPORATION (THE “COMPANY”) PURSUANT TO THE LOCAL ECONOMIC DEVELOPMENT ACT AND THE CITY OF BELEN ECONOMIC DEVELOPMENT PLAN ORDINANCE; APPROVING ECONOMIC ASSISTANCE FOR THE ECONOMIC DEVELOPMENT PROJECT IN THE CITY PURSUANT TO THE TERMS OF A PROJECT PARTICIPATION AGREEMENT AND AN INTERGOVERNMENTAL AGREEMENT; AUTHORIZING THE EXECUTION OF A PROJECT PARTICIPATION AGREEMENT BETWEEN THE COMPANY AND THE CITY AND AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE STATE AND THE CITY; AUTHORIZING THE EXECUTION OF ALL OTHER NECESSARY DOCUMENTS; MAKING CERTAIN DETERMINATIONS AND FINDINGS RELATING TO THE PROJECT; RATIFYING CERTAIN ACTIONS TAKEN PREVIOUSLY; AND REPEALING ALL ACTIONS INCONSISTENT WITH THIS ORDINANCE.

Complete copies of the proposed Ordinance are on file and available for public inspection during the normal and regular business hours of the City Clerk, whose office is located at Belen City Hall, 100 South Main St., Belen, New Mexico 87002, upon request and payment of a reasonable charge.

This notice constitutes compliance with NMSA 1978, Section 3-17-3 (1973).
