GREETINGS:
You are hereby notified that suit has been filed against you by the City of Belen, as Petitioner in the above-named court. The general object of this suit is condemn and acquire real property, property rights, easements and licensures located in the City of Belen, Valencia County, New Mexico, for the purpose of constructing drainage improvements, sidewalk and pedestrian facilities, rehabilitating the roadway and reconstructing the curb and gutter. The property is commonly known as 901 Cavalier Road or 901 W. Aragon Road, Belen, New Mexico, 87002.
The description of the property respondent seeks to be condemned is as follows:
A Parcel Of Land Comprising A Portion Of The Property Of The Grantor Within The Belen Grant, Southwest Quarter Of The Southwest Quarter (Sw1/4 Sw1/4) Of Projected Section 7, Township 5 North, Range 1 East, New Mexico Principal Meridian, Belen, Valencia County, New Mexico, As Said Property Is Described In The Quit Claim Deed Filed In The Office Of The Valencia County Clerk On October 29, 2013 As Document No. 2013134980, Said Parcel Being More Particularly Described Using New Mexico State Plane Grid Bearings (Central Zone, Nad 83) And Horizontal Ground Distances As Follows:
Beginning At A Point 14.79 Feet Right, Southerly And Opposite Of W Aragon Road Construction Centerline Pot Station 35+66.40 Of N.M.P. No. A301880, Said Point Of Beginning Being The Northwest Corner Of The Property Of The Grantor, Said Point Of Beginning Also Being A Point Of Intersection Of The New Southerly Right-Of-Way Line Of N.M.P. No A301880 With The Present (2020) Southerly Right-Ofway Line Of W Aragon Road, From Which Control Point 106 (Spike) Bears N69°46’53"E Distance Of 67.26 Feet;
Thence, From Said Point Of Beginning, S71°26’24"E A Distance Of 165.00 Feet Along The Present (2020) Southerly Right-Of-Way Line Of W Aragon Road And The Northerly Boundary Line Of The Property Of The Grantor To A Point;
Thence S33°17’16"E A Distance Of 68.00 Feet Along The Present (2020) Southerly Right-Of-Way Line Of W Aragon Road To The Northeast Corner Of The Property Of The Grantor, Said Point Also Being A Point Of Intersection Of The Present (2020) Southerly Right-Of-Way Line Of W Aragon Road And The Present ( 2020) Westerly Right-Of-Way Line Of Cavalier Road;
Thence Leaving The Present (2020) Southerly Right-Of-Way Line Of W Aragon Road S07°34’32"W A Distance Of 36.58 Feet Along The Present (2020) Westerly Right-Of-Way Line Of Cavalier Road And The Easterly Boundary Line Of The Property Of The Grantor To The South East Corner Of The Property Of The Grantor, Also Being The Point Of Intersection Of The Said Present Westerly Right-Of-Way Line With The New Southerly Right-Of-Way Line Of N.M.P.
